Wimo Technologies Private Limited ("Company", or "we" or "our" or "us") operates the Wimo platform ("Wimo Platform"), which enables users in select States of India ("Users", or "you") and its grammatical variations) to use and access any mobile based applications, websites, content, product and services, web applications and any related services offered by the Company through the Wimo Platform (collectively referred to as "Services") to exercise his/her knowledge and based on publicly available information (including information source made available through the Wimo platform) trade opinion on the probability of occurrence of a future real world event.

This policy ("Privacy Policy") forms an integral part of the Terms of Service between the Company and Users, and governs how the Company collects, uses, shares, and protects the personal and non-personal information disclosed by users in the course of their usage of the Services. Accordingly, you are advised to read this Privacy Policy carefully before accessing the Wimo Platform and the Services. By accessing the Wimo Platform you accept this Privacy Policy and you consent to our collection, storage, and use of your and/or your child’s personal information as described in this Privacy Policy. Each time you visit the Wimo Platform and any time you voluntarily provide us with information, you agree that you are consenting to our collection, use and disclosure of the information that you provide, and you are consenting to receive emails or otherwise be contacted, as described in this Privacy Policy.

1. TYPES OF INFORMATION COLLECTED

    1.1. We may collect the following types of information:

    a. Information you provide: When you register on the Wimo Platform, you will be required to provide us with your name, location, email address, mobile number, display picture, social media account ID (where submitted by you), and other relevant profile information. Additionally, you may be required to provide your bank account details when you make use of the add cash or cash withdrawal options for playing with real money, and your Permanent Account Number (PAN) when you use the cash withdrawal option, where applicable.

    b. Transaction details initiated by you: If you initiate a cash transaction in relation to your Wimo Account, we receive and store details pertaining to such transaction, including the payment method used, the amount added to the Wimo Account, and the date and time of the transaction.

    c. Interaction information: When you interact with our customer support over any medium, such interactions may be recorded and stored.

    d. Technical information about you: - We automatically collect certain information from you when you use the Wimo Platform, including your IP address, location, other unique device identifiers, your browser type, language, the URL of the website which you may have used to reach our Platform, and cookies (defined below).

    e. Usage information: When you participate in any of the specified future real-world events listed on the Wimo Platform, including Cash Events, and non-cash events available in various formats and variations on the Wimo Platform, we collect details related to the manner of your use of and interaction with the Wimo Platform and other Users such as the date and time during which you accessed the Wimo Platform, location from where you access the Wimo Platform, the amount of money spent by You in participating in the specified future real-world events listed on the Wimo Platform (where applicable) and the formats and variations you participate in.

    f. Messages: When you use the Wimo Platform to communicate, we receive and store the messages you may send or receive on the Wimo Platform, and any other content you may upload or share on the Wimo Platform (if applicable).

    g. Cookies: We use cookies, small text files that uniquely identify your browser and enable us to recognize the information you have consented to give us, to store certain types of information each time you visit any page on our Platform. These cookies do not contain any personal information and you may choose what cookies you allow by managing your cookies settings on your browser. This will allow you to delete your browser cookies or disable them entirely, however, if you choose to disable all cookies, it will affect your overall experience with the Wimo Platform— it may make parts of the Wimo Platform non-functional or inaccessible to you in such cases. Therefore, we recommend that you enable cookies for the Wimo Platform. The cookies we collect are mainly used to serve advertising banners to you and in doing so we may use the services of third parties. Such third-party service providers do not know the name, phone number, address, email address, or any personal information about you, and no personal information is collected or used in this process.

    h. Web beacons: We use web beacons, images that are part of the web pages, also called pixel tags or clear gifs, in combination with cookies to understand how you interact with the Wimo Platform and the content therein. When you disable cookies, web beacons are also likely to become ineffective. You can also add browser extensions to specifically block web beacons.

    i. Social Media: We may collect information when you interact with our social media accounts and pages such as on LinkedIn, Twitter, Instagram, Facebook etc.

    j. Based upon the information that you provide to us at the time of registration, we may contact you via a telephone call to understand your requirements in detail and provide further information about our Services. By providing your mobile phone number or landline telephone number you are expressly consenting to us contacting you in spite of any registrations you may have with your telecom providers “Do Not Disturb” registry. We may also communicate with you via email correspondence. We may also use your information to send you updates and other promotional communications. If you no longer wish to receive email correspondence or updates from us, you may opt-out of receiving them you may contact us and let us know.
    1.2. Some of the information that we require you to provide on first accessing or registering on the Wimo Platform is mandatory and/or essential to the provision of our Services to you, and hence if you do not provide such mandatory information, you may not be able to access some of the features of the Wimo Platform.

2. USE OF INFORMATION

    2.1. In addition to the uses of information described elsewhere in this Privacy Policy, we use your information to do the following:

    (a) to enable your access and use of the Wimo Platform and the Services.
    This includes, without limitation, to create/update user accounts, enable provision of Services and the Wimo Platform to you, process cash transactions to your Wimo Account and enable withdrawals (where applicable), facilitate your participation in various types of formats of events listed on the Wimo Platform and for verification of user accounts.

    (b) for customer support
    This includes, without limitation, to provide customer support, including to investigate and address user concerns and to monitor and improve our customer support responses and processes.

    (c) for research and development
    This includes using the information provided by you for testing, troubleshooting, research, analysis, product development, machine learning, statistical, internal training and quality management purposes to improve the user experience and the Wimp Platform. This helps us make our services more convenient and easy-to-use, enhance the safety and security of our services, and develop new services and features.Such analysis is aggregated and does not pertain to any specific User.

    (d) to send marketing and non-marketing communications to users
    This includes using the information provided by you to (i) market our Services or products or those of our group companies, affiliates and subsidiaries to You. This includes sending users communications about the Services, features, promotions, sweepstakes, studies, surveys, news, updates, and events. We may do so through various methods, including email, text messages, push notifications, in app communications and ads, and ads on third party platforms. We may also use the information to measure and understand the effectiveness of the promotions, and advertisements we serve to you and others; personalize the Wimo Platform for you, including the promotions and advertisements that may be served to you. We may use the information we collect, including in combination with advertising partners’ data, to personalize and improve the marketing communications (including ads) that we send on and off Wimo Platform including based on user location, use of the Services, and user preferences and settings. We may use the information to generate and provide users with invoices; inform them of changes to our terms, services, or policies; or send other communications that aren’t for the purpose of marketing the services or products of the Company or its partners.

    (e) in connection with legal proceedings
    This includes making disclosures required by law on receipt of a lawful notice from a competent statutory/investigatory authority. Such disclosures will be made in compliance with the applicable law and we will be under no obligation to inform you of such disclosure to the competent authority. We may also be required to disclose your information to a competent authority if it is found that you have violated our Platform Policies and/or have committed an illegal act while using our website and/or Services. We may also use the information to investigate or address claims or disputes relating to use of the Services.
    2.2. We do not sell or rent or otherwise share your information with third parties without your consent.
    2.3. In case you use the referral program (if any), we use your name/email address in the heads of the email/SMS sent to the person referred; and the name, mobile number, and email address of the person referred, to communicate with them.
    2.4. Optional use: We may use your personal information for the purpose of testimonials and other promotions.

3. Storage of Information

    3.1. The information collected by us from Users of the Wimo Platform is securely stored and processed on servers located in India.
    3.2 Some of our affiliates and/or service providers may store or process information in jurisdictions other than India.

4. Sharing of Information

    4.1. We may share your information with various third parties who assist us in providing you with our Services, including the following:

    (a) Authorised third party vendors and services providers
    We may share your personal information with vendors and other third-party providers who are performing services for the Company. In general, the vendors and third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide for the Company. These services by such vendors shall include but not be restricted to payment information required by a payment aggregator/gateway to process a payment made for the Services,Service providers, such as information technology and payment service providers, whose services may form a part of or may be necessary for the provision of our services; advertisers and advertising networks that require the information to select and serve advertisements to you and other Users; Cloud storage providers to store the information you provide and for disaster recovery services, as well as for the performance of any contract we enter into with you; analytics and search engine providers that assist us in the optimisation and improvement of the Platform; entities that provide us with marketing assistance; and entities that provide us with customer support services.

    (b) Affiliates and group companies
    We may share your personal and non-personal information with our subsidiaries, affiliates and group companies to help us provide our Services and the functioning of the Wimo Platform and for our internal business purposes including without limitation data analysis.

    (c) Law Enforcement Agencies & Government Authorities
    We may share your information with law enforcement agencies, public authorities, or other organizations, if legally required to do so, or if such use is reasonably necessary to: comply with any legal obligation, process, or request from government or judicial authorities; enforce our Platform Policies, including investigation of any potential violation thereof; detect, prevent, or otherwise address security, fraud, or technical issues; or protect the rights, property or safety of the Company, our Users, third party or the public as required or permitted by applicable law (including exchanging information with other companies and organizations for the purposes of fraud prevention).

    (d) Corporate Transactions
    We may share your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, reorganization, financing, change or control or acquisition of all or a portion of our business by another company or third party, asset sale, initial public offering, or in the unlikely event of bankruptcy or similar proceeding. The buyer or transferee would be obligated to honour the commitments made in this Privacy Policy.
    4.2. The service providers we engage are bound by data processing agreements that require them to take sufficient technical and organizational measures to safeguard your information.

5. Third party platform and service

    5.1. The Wimo Platform may contain links to third-party websites or services (“External Resource”). Your browsing on and interaction with any External Resource, irrespective of whether the link to such External Resource originated on our Platform, is subject to the terms of use and privacy policies of such External Resource. We are not responsible for the functionality, privacy, or security measures of any other entity and this Privacy Policy will not govern your use and access of such website or service you are redirected to.

6. Retention of Information

    6.1. We retain your information for as long as is necessary to provide you with our services; thereafter, we may retain your information to comply with our legal obligations, resolve disputes and enforce our agreements, and to protect the Company’s legal rights, subject to limitations under applicable laws.

7. Security and Safety of your Information

    7.1. We use industry-standard and legally mandated safeguards to keep the information collected by us secure. These measures include periodic reviews of our data collection practices, storage and processing practices, cyber security measures such as encryption, and physical security measures to guard against unauthorized access to systems where we store Users’ personal information. We have a comprehensive information security program and information security policies that contain managerial, technical, operational and physical security control measures adequate for the protection of personal information, including sensitive personal information. However, these measures do not guarantee that your information will not be illegally or unauthorizedly accessed, disclosed, altered or destroyed by breach of such precautions. By using our Services, you acknowledge that you understand and agree to assume these risks.
    7.2. When you register with us, your account is protected by means of a unique password, which is known to or may be accessed only by you. You are responsible for maintaining the secrecy of your unique password and Wimo Account information, and for controlling access to emails between you and us, at all times. Therefore, you should not provide your password to anyone whosoever: breach thereof constitutes a violation of the Platform Policies and may result in termination of your Wimo Account in certain cases. If you become aware of or reasonably suspect any breach of security of your Wimo Account, including compromise of your password, you must notify us immediately. The Company shall not be responsible for any form of information, financial, reputational etc loss to the User due to breach of his/her login info of the Wimo Account.

8. Age Restriction

    8.1. The Wimo Platform is not intended or directed at anyone under the age of 18 years, and we do not knowingly collect or solicit any information from, or allow the registration on the Wimo Platform of, anyone under the age of 18 years. By using the website, you represent that you are at least 18 years of age.
    8.2. Upon learning that we have collected personal information from a User under the age of 18 years, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under the age of 18 years, please contact our Grievance Officer in the manner provided in Clause [9] below.

10. Preferences and Rights

    10.1. Access and Updation You may access and update the personal information that you have provided to us by logging into your Wimo Account, and using the options available therein, though this may be restricted in instances where you are not able to verify your identity or there is any suspicious activity associated with your account.
    10.2. Withdrawal from providing information You have the right to withdraw or decline your consent to the collection of any information you provide us at any time by writing to us at support@getwimo.com. Please note, this may affect your usage and access to the Wimo Platform.
    10.3. Communications Opt-Outs You can opt-out of marketing or advertising emails by sending an email to support@getwimo.com.

11. Changes to Privacy Policy

    We reserve the right to change this Privacy Policy and our Platform Policies at any time. You will be informed of any changes to our Privacy Policy when such changes are effected.
